The Elaine & Theo mobile message service (the “Service”) is operated by Elaine & Theo (“Elaine & Theo,” “we,” or “us”). Your use of the Service constitutes your agreement to these Mobile Terms. We may modify or cancel the Service or any of its features without notice. To the extent permitted by law, we may also modify these Mobile Terms at any time; continued use after changes take effect constitutes acceptance.

By consenting to Elaine & Theo’s SMS/text messaging service, you agree to receive recurring text messages from and on behalf of Elaine & Theo through your wireless provider to the mobile number you provided, even if your number is on a Do Not Call list. Messages may be sent using an automatic telephone dialing system or similar technology. Service-related messages may include updates, alerts, and information (for example: order updates, account alerts). Promotional messages may include promotions, specials, and other marketing offers (for example: cart reminders).

Your consent is not a condition of purchase. Participation is voluntary.

We do not charge for the Service, but standard message and data rates may apply. Message frequency varies. You are responsible for all charges from your wireless provider.

You may opt out at any time by replying STOP to any message or by following the unsubscribe instructions included in each message. You will receive a one-time confirmation text. No further messages will be sent unless initiated by you. If you have subscribed to other Elaine & Theo mobile programs, you must opt out separately for each, unless otherwise required by law.

We may change any short code or phone number used for the Service and will notify you. Messages sent to an old number may not be received; we are not responsible for honoring requests sent to deactivated numbers.

Wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide a valid mobile number. If you change numbers, re-subscribe with your new number.

To the extent permitted by law, we are not liable for failed, delayed, or misdirected delivery of information sent through the Service, any errors in such information, and/or actions you take or do not take in reliance on the information or Service.
